I saw Peak on night of 28th, after he had been suspended from duty.
About five minutes to eleven Peak came in and said: -
"I have been suspended from duty. What is the matter with me?"
I said "No. I see nothing the matter with you"
I saw nothing unusual about Peak.
I then asked Peak why he was sent off duty and he said that he was sent off for being drunk and that the Chief Warder had refused to allow him to see a doctor.
Peak said: "Do you think that it would be advisable to see a doctor?"
I said "Oh. Nonsense, go to your room. There is no such thing as drunkenness about you".
That is about all I remember.
I was lying in bed. I had not been asleep. I did not get up at all.

I am a warder in Victoria Gaol.
I have been a warder nearly 7 months.
I saw Peak on the night of the 28th June between 8 and 9 and afterwards shortly after 10.30.
At 10.30 I was up in our sleeping quarters just turning in when Peak came into the room.
I asked him why he had come back, and he told us that he had been sent off duty for being drunk.
I thought he was skylarking.
After a little while he went away, I believe to see a doctor. At last we advised him to go and get a medical certificate that he was sober.
At the time he was perfectly sober.
That is all I know about it.
